Privacy policy

1. Data controller

The controller of the personal data collected through this site is Lusoak Imóveis, Lda., with its registered office at Travessa Bouça do Monte, 66, 4445-357 Ermesinde, corporate tax number 518783715, holder of licença AMI (the Portuguese estate agency licence) no. 25701, contactable at jose.carvalho@lusoak.pt.

2. Data collected

The contact form collects the name, email address, telephone number, property reference and the content of the message. Where the enquiry proceeds commercially, the identification details required by the legislation applicable to estate agency may also be collected.

This site also counts page views, so as to know which content is being looked for. Each view records four things only: the address of the page, the site it belongs to, the moment it was opened and the domain the visit came from, a search engine for instance. Only the domain name is kept, never the full referring address, which could carry search terms. No IP address, device type or identifier of any kind is collected, no cookies are used, and there is no way to link two views to the same person. The counting is done in the company's own database, referred to in point 5, with no third party involved. Whoever manages the site may exclude visits made from their own device from the count: a marker to that effect is then kept in that browser, is never sent to the server and identifies no one.

3. Purpose and lawful basis

The data is processed in order to answer the enquiry, to present properties matching the criteria given and, where a transaction follows, to perform the agency contract. The basis is consent, the taking of steps prior to a contract and compliance with a legal obligation.

4. Retention period

Enquiries with no follow-up are kept for one year from the last communication and deleted at the end of that period. Data associated with agency contracts follows the applicable statutory retention periods, as a rule ten years for tax and accounting purposes, without prejudice to the seven-year period stated in point 7.

5. Disclosure to third parties

The data may be disclosed to owners, buyers, notaries, land registry offices, credit institutions and credit intermediaries, only to the extent necessary to complete the transaction, and to technical service providers Amen, which hosts the pages of this site, Supabase, which receives and stores the requests sent through the form together with the property data and photographs, and Resend, which delivers the notification by email.

6. International transfers

Requests sent through the form, together with the property data and photographs, are received and stored on servers located in Ireland, within the European Union. The email notification is delivered by Resend, a company established in the United States, so the data contained in that notification, the name, email address, telephone number and the content of the message, may be processed outside the European Economic Area. That transfer is subject to the safeguards required by the General Data Protection Regulation for transfers to third countries.

7. Client identification and prevention of money laundering

Estate agency work in Portugal is subject to Lei n.º 83/2017, de 18 de agosto, the law on combating money laundering and terrorist financing. Under that law Lusoak Imóveis is an entidade obrigada, and IMPIC, I.P. is the sector authority that supervises how estate agencies comply with these duties.

As a result, before a contrato de mediação is signed and before any transaction is completed, Lusoak Imóveis must identify and verify the identity of its clients, their representatives and the other parties to the transaction. Depending on the case, the following are collected:

  • a valid photographic identity document and the número de identificação fiscal (NIF);
  • for a company, the certidão permanente or its access code, the identity of the members of the management body and the identity of the beneficial owners;
  • the address, the occupation or business object, and the nature of the intended business relationship;
  • information on the source and destination of the funds involved, where the law requires it.

This processing is not based on consent: it follows from a legal obligation to which Lusoak Imóveis is subject. Without these elements the law imposes a duty of refusal, and the company may not begin or continue the business relationship.

Data collected under this regime is kept for seven years after the transaction is completed or the business relationship ends. That period is set by law and is separate from the one stated in point 4.

The law also requires suspicious transactions to be reported to the Departamento Central de Investigação e Ação Penal and to the Unidade de Informação Financeira, and requires details of property transactions to be reported to IMPIC, I.P. as that authority determines. These reports are mandatory and do not depend on the data subject's authorisation. Where a suspicious transaction is reported, the law forbids telling the client that the report has been made.

The rights set out in point 8 apply to this data subject to the limits of that law. In particular, the processing cannot be objected to, and these elements cannot be erased, while the legal retention period is running.

8. Rights of the data subject

The data subject may request access to, rectification of, erasure of, restriction of the processing of and portability of their data, object to the processing and withdraw consent at any time, without prejudice to statutory retention obligations. Requests should be addressed to jose.carvalho@lusoak.pt.

There is also the right to lodge a complaint with the Comissão Nacional de Proteção de Dados (the Portuguese data protection authority).

9. Cookies

This site does not use its own analytics cookies, nor third-party cookies. The typefaces are served from this same server, so a visit does not communicate the visitor's IP address to any external party.

10. Changes
